Terms of Service

1. Acceptance of Terms

By creating an account or using SellBetter (“the Service”), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms form a binding agreement between you and SellBetter (“we,” “our,” or “us”).

2. The Service

SellBetter provides automated Shopify store audits and AI-powered conversion rate optimization (CRO) recommendations. The Service analyzes your public storefront and, if you choose to connect via Shopify OAuth, your store’s API data, to produce a conversion score, a prioritized task board, and actionable fix instructions.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for material changes.

3. Account Registration

• You must provide accurate information when creating an account.
• One account per merchant. You may not create multiple accounts to circumvent plan limits.
• You are responsible for maintaining the security of your login credentials.
• You must be at least 18 years old and authorized to act on behalf of any business entity you represent.

4. Acceptable Use

You agree not to:

• Use the Service to run automated bulk audits of competitor stores at scale.
• Resell, redistribute, or commercially exploit audit data or reports without our written consent.
• Attempt to reverse-engineer, scrape, or extract data from the SellBetter platform itself.
• Use the Service in any way that violates applicable laws or Shopify’s Partner Program Agreement.
• Share your account credentials with third parties outside your organization.

5. Shopify Data Access

When you connect your Shopify store, SellBetter requests read-only API access by default. We use this access solely to improve the accuracy of your audit results. We do not modify your store data unless you are on the Autopilot plan and have explicitly enabled and approved individual auto-fixes.

You may revoke our Shopify access at any time by uninstalling the app from your Shopify admin. We will clear your access token within 48 hours of uninstall.

6. Payment and Subscriptions

• Billing: Paid plans (Pro at $29/month, Agency at $49/month) are billed monthly via Stripe. Prices are in USD and exclude applicable taxes.
• Free trial: The Free plan allows one audit with no time limit and no payment required.
• Cancellation: You may cancel your subscription at any time from Settings → Billing. Your access continues until the end of the current billing period, after which your account downgrades to Free.
• Refunds: We do not offer refunds for partial months. If you cancel mid-cycle, you retain access through the end of the period you paid for.
• Price changes: We will give at least 30 days’ notice before changing subscription prices. Continued use after the change takes effect constitutes acceptance.

7. Disclaimer of Warranties

The Service is provided “as is” and “as available” without any warranties of any kind, express or implied. SellBetter’s recommendations are based on industry CRO benchmarks and automated analysis. We do not guarantee that following our recommendations will result in any specific increase in revenue, conversion rate, or other business outcome. Actual results vary by store, product, audience, and market conditions.

8. Limitation of Liability

To the maximum extent permitted by law, SellBetter shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability to you for any claim arising out of or relating to these terms or the Service shall not exceed the greater of $100 or the amount you paid to us in the 12 months preceding the claim.

9. Account Termination

You may delete your account at any time from Settings → Danger Zone. Deletion permanently removes all your stores, audits, and associated data.

We may suspend or terminate accounts that violate these Terms, abuse the Service (e.g., running automated bulk requests), or engage in fraudulent activity. We will provide notice where reasonably practicable.

10. Intellectual Property

SellBetter and its underlying technology, including the audit methodology, scoring algorithm, and AI fix generation, are our proprietary property. You may not copy, reproduce, or create derivative works based on our platform without written permission.

You retain full ownership of your store data. By using the Service, you grant us a limited licence to process your data solely to deliver the Service.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the revised Terms.
